This privacy policy explains how Soluciones Botánicas Sàrl processes personal data when you visit solucionesbotanicas.com, contact us, request a quote, subscribe to our newsletter or do business with us. We keep it short and honest: we collect little, we do not sell data, and we do not use advertising trackers.

2. Which law applies
We are a Swiss company and process personal data under the Swiss Federal Act on Data Protection (FADP) and its ordinance. Because we also supply customers in the European Union and the European Economic Area, the General Data Protection Regulation (GDPR) may apply to the data of people located there. Where this policy mentions legal bases or rights that exist only under the GDPR, they apply to those people.
3. What data we process, why, and for how long
3.1 Visiting the website
When you open a page, our hosting provider automatically records technical data in server logs: your IP address, the date and time, the page requested, the referring page, and your browser and operating system. We use this data to deliver the site, keep it secure and diagnose faults. It is kept for a short period, typically no more than a few weeks, and then deleted, unless we need it to investigate a security incident.

3.2 Contact form and quote request
When you use the contact form or the quote request form we process the data you type in: your name, company or organisation, email address, phone number, address, the sector you work in, and your message. We use it to answer you, to assess whether we can help, and to prepare an offer.
The data is stored in the database of this website and in our mailbox. We delete enquiries that do not lead to a business relationship after 24 months at the latest. If an enquiry leads to a contract, the data becomes part of the customer record described in section 3.4.

3.3 Newsletter
If you subscribe to our newsletter we process your email address and, if you give it, your name. We use a double opt-in: you receive a confirmation email and only become a subscriber once you click the link in it. We record the date and IP address of the subscription and the confirmation so that we can prove your consent.
We send the newsletter through Intuit Mailchimp. Mailchimp records whether an email was opened and which links were clicked, which helps us understand what our readers find useful. You can unsubscribe at any time using the link at the bottom of every newsletter or by writing to us. We keep your data until you unsubscribe, and keep the record of your consent and withdrawal for up to three years afterwards.

3.4 Customers, suppliers and partners
If you become a customer, a supplier or a business partner, we process the data needed to run the relationship: contact details of the people we deal with, contract terms, batch and delivery records, correspondence, invoices and payment records. We keep contracts and accounting records for ten years as required by the Swiss Code of Obligations, and other correspondence for as long as the relationship lasts and a reasonable period afterwards.

3.5 WhatsApp button
The site shows a WhatsApp button. Nothing is sent to WhatsApp until you click it. If you do, the conversation takes place in WhatsApp, a service of Meta Platforms, under Meta’s own terms and privacy policy. We see your phone number and the messages you send us and treat them like any other enquiry.
3.6 Social media links
The links to Instagram, Facebook and LinkedIn are plain links. No data is transferred to these platforms while you browse our site. When you click one, the platform’s own privacy policy applies.
4. Data we do not collect
You do not need an account to use this site, we do not take payments online, and we do not use analytics, advertising or social media tracking. We do not carry out automated decision-making or profiling.
5. Who receives your data
We share personal data only with providers that help us run the business, and only to the extent needed for their task:
- Hosting: this website and its database are hosted by LucusHost in the European Union (Spain).
- Newsletter: Intuit Mailchimp (The Rocket Science Group LLC), United States.
- Email and office tools: the providers that run our mailboxes and documents.
- Transport: when we ship plant material, the carrier receives the delivery address and contact details.
- Advisors and authorities: accountants, lawyers or public authorities where we are legally required or entitled to disclose data.
We never sell personal data and we do not pass it to third parties for their own marketing.
6. Transfers outside Switzerland
Our hosting is in the European Union, which Switzerland recognises as providing adequate data protection. Mailchimp is based in the United States. Mailchimp is certified under the Swiss-U.S. Data Privacy Framework and the EU-U.S. Data Privacy Framework and, in addition, has committed to the Standard Contractual Clauses in its data processing agreement. On this basis, newsletter data transferred to the United States benefits from safeguards recognised by Swiss and EU law.
7. How we protect your data
The website is served over HTTPS. Access to the administration area, the form entries and our mailboxes is limited to the people who need it and protected by individual passwords. Our hosting provider applies its own technical and organisational security measures.
8. Your rights
You have the right to:
- ask whether we process data about you and receive a copy of it;
- have inaccurate data corrected;
- have your data deleted, unless we must keep it by law;
- receive the data you gave us in a common electronic format;
- object to processing based on our legitimate interests;
- withdraw a consent you have given, for example to the newsletter, with effect for the future.
To exercise these rights, write to info@solucionesbotanicas.com. We may ask you to confirm your identity. We answer within 30 days.
If you believe we are processing your data unlawfully, you can complain to the Swiss Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, Switzerland. People located in the EU or EEA may also complain to the data protection authority of their own country.

This site uses only the cookies needed to remember your language and to make the forms work. There are no analytics or advertising cookies. Details are in our cookie policy.
